Mariners Point Home Co. LLC — Terms of Service

These Terms of Service (“Terms”) govern your access to and use of www.marinerspointhome.com (the “Site”) and any related online services provided by Mariners Point Home Co. LLC (“Mariners Point Home,” “we,” “us,” or “our”).

By accessing or using the Site, submitting a form, requesting an estimate, or scheduling a consultation, you agree to these Terms. If you do not agree, do not use the Site.

1) Services; Website Content Is Informational Only

Mariners Point Home provides residential home services, which may include interior/exterior painting, cabinet refinishing, garage floor coatings, and related services (collectively, the “Services”).

All content on the Site (including photos, descriptions, service lists, timelines, pricing ranges, and FAQs) is provided for general information only and is not a binding offer, proposal, or guarantee. Any pricing, timelines, and availability shown are estimates only and may change based on site conditions, scope, materials, schedule, HOA requirements, permits, or other factors.

A job is only confirmed when we provide a written scope/proposal (or Work Order) and it is accepted per our documented acceptance process (e.g., signature/approval and any required deposit).


2) Eligibility

You must be at least 18 years old to use the Site or request Services.


3) Requests, Forms, and Accuracy of Information

When you submit information through the Site (including Framer Forms), you agree to provide accurate and complete information. If you provide incorrect contact information or incomplete project details, we may be unable to respond or may provide inaccurate preliminary guidance.


4) Communications Consent (Calls, Texts, Email)

By providing your phone number and/or email and submitting a request, you authorize Mariners Point Home to contact you at the information you provided for service-related purposes, which may include:

  • responding to your inquiry,

  • providing an estimate or scope clarification,

  • scheduling or rescheduling appointments,

  • job updates,

  • customer service follow-ups,

  • invoicing/payment communications (if applicable).

We may contact you by phone call, SMS/MMS text message, and email, including through service providers (such as our CRM/scheduling platform, Workiz). Message and data rates may apply.

Marketing messages (if any) will only be sent where permitted and consistent with your preferences.
Text Opt-Out: Reply STOP to opt out of text messages. Reply HELP for help.
Email Opt-Out: Use the unsubscribe link (if provided) or contact us.


5) Scheduling, Access, and Cancellations

If you schedule a consultation or site visit:

  • You agree to provide reasonable access to the property and relevant areas (including gated access instructions, HOA rules, parking instructions, and pet notes).

  • You agree to notify us as soon as possible if you need to cancel or reschedule.

We reserve the right to reschedule appointments due to weather, staffing, material availability, safety concerns, or circumstances outside our control.

If you want, I can add a specific cancellation window + trip fee language (common for SWFL).


6) Payments, Deposits, and Change Orders

Unless otherwise stated in writing:

  • Any deposit requirements, payment schedule, and acceptable payment methods will be provided in your written proposal/work order.

  • Additional work not included in the written scope may require a change order and may affect schedule and price.

If online payment links are provided, they may be processed through third-party payment processors. We do not control those processors and are not responsible for their systems.


7) Warranty Information

Any warranties (if offered) are provided in our written warranty documentation and/or your job paperwork. Website statements about durability, performance, or warranty are general and may depend on substrate conditions, prep requirements, maintenance, and usage.


8) Third-Party Services and Tools

We may use third-party services to operate our Site and business, including:

  • Framer (website and forms),

  • Workiz (CRM/scheduling/communications),

  • Analytics tools (e.g., Google Analytics),

  • Advertising tools (e.g., Meta Pixel/ads).

Your use of third-party websites/services is governed by those providers’ terms and policies. We are not responsible for third-party platforms.


9) Privacy Policy

Our collection and use of personal information is described in our Privacy Policy. Please review it for details on cookies, analytics, and advertising.


10) Intellectual Property

All Site content—including text, photos, graphics, branding, logos, designs, and layout—is owned by Mariners Point Home or licensed to us and is protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works without our written permission.


11) User Submissions (Photos, Reviews, Messages)

If you submit content to us (such as photos of a project, reviews, testimonials, or messages), you grant Mariners Point Home a non-exclusive, royalty-free license to use that content for business purposes (e.g., project evaluation, customer service, and—with your permission—marketing/portfolio use). If you do not want us to use your submission for marketing, tell us in writing.


12) Prohibited Uses

You agree not to:

  • misuse the Site, interfere with its operation, or attempt unauthorized access;

  • submit false information, impersonate others, or attempt to solicit private information;

  • use the Site for unlawful, abusive, or harmful purposes;

  • scrape, harvest, or collect data from the Site without permission.


13) Disclaimer of Warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.


14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARINERS POINT HOME WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID US THROUGH THE SITE (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

(These limitations do not apply where prohibited by law.)


15) Indemnification

You agree to defend, indemnify, and hold harmless Mariners Point Home and its owners, employees, contractors, and agents from and against claims, damages, liabilities, costs, and expenses arising from your use of the Site, your violation of these Terms, or your violation of any law or third-party rights.


16) Governing Law; Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising out of or relating to the Site or these Terms will be brought in the state or federal courts located in [Collier County, Florida] (or another county you designate), and you consent to jurisdiction and venue there.


17) Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted, as shown by the “Effective Date.” Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
